Tue., 12:12pm: Opponents of OH village’s traffic cameras sue

HAMILTON -- A lawsuit alleging that traffic cameras used to trap speeders in a southwest Ohio village violate the state constitution has been filed after a judge ordered similar cameras removed in another Ohio village.

The lawsuit filed last week in Butler County against New Miami by four area residents and businesses alleges the camera ordinance violates their constitutional right to due process. The lawsuit also names New Miami police Chief Kenneth Cheek as a defendant.

A Hamilton County judge who struck down the use of traffic cameras in the village of Elmwood Place said they violated due process.

The latest lawsuit wants an order striking down the New Miami ordinance.

New Miami's attorney said Tuesday he hasn't seen the lawsuit and has no comment. A message also was left for Cheek.
